Rights Groups to ICE: Stop Raids for Census

OAKLAND, Calif. – Immigrant rights advocates have sent a letter to President Barack Obama and Department of Homeland Security (DHS) Secretary Janet Napolitano asking them to immediately suspend all immigration enforcement activities through the end of the year in order to decrease fear within immigrant communities and encourage their participation in the 2010 Census.

Questionnaires for the 2010 Census are due to arrive in the mailbox of every U.S. household between now and April 1.

“We are genuinely concerned that the climate of fear will seriously impact the census form return rate of immigrant households -- and if people do not return the form, they will be reluctant to open the door to a follow-up visit from a census worker," said Catherine Tactaquin, director of National Network for Immigrant and Refugee Rights (NNIRR). "We really need the leadership of the administration right now to make a difference in the success of the census among our diverse immigrant populations."

The letter, which was signed by more than 200 organizations nationwide, calls for the suspension of more than a dozen specific enforcement activities operated through DHS, including immigration raids on homes and workplaces.

ICE Responds

ICE spokesperson Lori Haley told NAM she was unaware of the immigrant advocates’ letter. In a prepared statement, the agency said that ICE “fully supports an accurate count of the U.S. population,” and would prioritize enforcing laws “on those dangerous criminal aliens who present the greatest risk to the security of our communities, not sweeps or raids to target undocumented immigrants indiscriminately.”

The problem, according to Arnoldo Garcia , a program director at NNIRR in Oakland , is that ICE raids result in only 2 percent of the roughly 500,000 deportations of immigrants that occur each year in the United States . “It would not be enough for Napolitano or congress to just say, ‘Okay, let’s suspend raids.’ That would be a gross injustice,” he said.

Even if ICE were to de-emphasize immigration raids, said Garcia, the majority of people being picked up and deported are a result of less visible strategies, like those arising from 287(g) agreements.

Such agreements allow local police and county sheriff departments to be trained by ICE in identifying potential “criminal aliens.” The result, said Garcia, is an increase in deportations and a growing mistrust of government and law-enforcement agencies within immigrant communities, including among legal permanent residents.

“Most people don’t realize that law enforcement is also deporting legal residents on criminal charges,” he said. “If you’re not a U.S. citizen, even if you are a legal permanent resident, you can still be subjected to deportation.”

Garcia says the organizations are simply asking the Obama administration and DHS to follow historical precedent. According to the letter, the federal government eased immigration enforcement activities during at least the last two decennial census campaigns.

Historical Precedent

The letter references a quote from Rep. Sylvestre Reyes, a Democrat from Texas , who told Fox News last year that when he was working for the Border Patrol during the lead-up to the 1990 census, he received orders to suspend some enforcement efforts.

There is other documentation that would suggest that the INS changed some of its operations during the 1990 census. For example, the INS commissioner sent a fax on Feb. 15, 1990 to all field offices, outlining guidelines for enforcement operations conducted while the census was being carried out, with the intention of deterring INS employees from “engaging in any conduct that is intended to inhibit or deter any person or group of persons from the fullest possible participation in the upcoming 1990 Census.”

The document goes on to state:

In keeping with an agreement between the Service and the Bureau of the Census, news releases or public announcements made by the Service with regard to Service enforcement activities will be temporarily discontinued during the period starting February 11, 1990 and ending July 31, 1990.

It is unclear from the commissioner’s fax whether the INS actually suspended activities, or simply stopped reporting them to the public.

Doris Meissner, who was head of INS during the 2000 Census, told the Orange County Register in January that she did in fact order suspension of “routine operations and enforcement activities” during the two weeks leading up to Census day, while allowing more serious enforcement involving criminal activities to continue unabated.

However, Meissner said that the likelihood of the Obama administration allowing even that to happen again is slim, considering how much the political landscape has changed since 2000.

“We definitely went further than what I’m hearing from this administration thus far,” she told the Register. “I think politically they feel more vulnerable and they may even believe that by going any further they would send signals that would embolden serious criminals and possibly terrorists.”

Census Bureau Promises Hands-Off Approach to Immigration

Regardless of what has occurred in the past, Census Bureau spokesperson Sonny Le says the bureau is taking a hands-off approach to the question of immigration enforcement in 2010. “We don’t request or interfere with other departments,” said Le. “Any decisions are going to have to come from Congress or the president.”

Nevertheless, NNIRR is optimistic that the Obama administration will recognize that the long-term benefits of an enforcement suspension outweigh any short-term political backlash.

“Having an accurate count of the immigrant population is not only good for immigrants,” said Garcia. “There has been a demographic revolution in this country over the last 10 years, and in those communities where there has been a big demographic change, if immigrants are undercounted, the whole community will be shooting itself in the foot.”

On Saturday, March 20, 2010 there will be a major national anti-war march that will start at the White House at noon. This will be the largest demonstration to date opposing the Obama Administration’s decision to expand the war in Afghanistan with tens of thousands more U.S. troops.

“Public opinion has shifted dramatically against the war in Afghanistan. As in Vietnam, the political and military leaders know that 'victory' is impossible, but they are sending ever more troops into battle and more Afghans and U.S. soldiers to their early grave so that these 'leaders' can avoid shouldering the responsibility for a perceived defeat. Thousands will be marching in Washington, D.C., and in Los Angeles and San Francisco on March 20 to demand the immediate end to the occupation of Afghanistan and Iraq,” stated Brian Becker, the National Coordinator of the ANSWER Coalition.

Washington, 19 de marzo.- La cita de la próxima semana del Grupo Consultivo México- Estados Unidos será dominada por temas de seguridad como el ataque a la influencia de los cárteles, el refuerzo del Estado de derecho, los derechos humanos y las instituciones democráticas.

Al hablar sobre el viaje de la delegación estadunidense, el secretario de Estado Adjunto para el Hemisferio Occidental, Arturo Valenzuela, destacó que entre éstos temas el de derechos humanos es algo que su país toma "seriamente" dentro del diálogo permanente y los esfuerzos de colaboración.

"Pero lo queremos hacer con el mayor respeto a la sensibilidad de México, a la soberanía de México", enfatizó.

La delegación será encabezada por la secretaria de Estado, Hillary Clinton, quien estará acompañada por el secretario de Defensa, Robert Gates; la secretaria de Seguridad Interna, Janet Napolitano; el director nacional de Inteligencia, Dennis Blair, y el asesor de Seguridad Nacional, John Brennan.

También viajarán el jefe del Estado Mayor Conjunto, almirante Michael Mullen; el subsecretario de Seguridad Interna, John Morton; el subprocurador general Gary Grindler, y la titular interina de la Administración Federal Antidrogas (DEA), Michelle Leonhart.

Valenzuela anticipó que lo relacionado con la violencia contra periodistas dentro de la lucha contra el narcotráfico se abordará en el marco del tema de derechos humanos.

La reunión en la Ciudad de México el próximo martes será la segunda que celebra el Grupo Consultivo de Alto Nivel, después de la primera convocada en la capital estadunidense en 2008.

El funcionario anticipó que al término del encuentro, las dos delegaciones darán a conocer un comunicado conjunto.

America no empieza ni termina en una frontera. America, tierra bella y milenaria que distingue a nuest ...ro planeta de otros en el sistema solar planetario, que pertenece la Galaxia de Andromeda, y a la Gran Creacion Universal, es una hermosa Madre Tierra, una Pachamama, una Tonantzin rodeada de aguas bellisimas, de mares que la besan, con una biodiversidad que antes fue infinita y hoy se encuentra amenazada por una explotacion irracional de los recursos y una transformacion genetica de los cultivos, y porque sus habitantes, tambien son irracionalmente explotados para el beneficio de unos cuantos.

A esta porcion del continente llamada Estados Unidos de America (Norteamerica), a esta tierra milenaria, como en un retorno mitico (Mircea Eliade dix it), muchos han querido o debido emigrar para mejorar sus condiciones de vida y las de su familia, en sentido inverso a los Primeros Pobladores de America que bajaron desde las Islas Aleutianas cruzando por el estrecho de Behering, y hasta la Patagonia (tesis que se complementa con las visitas polinesicas y asiaticas de ultramar).

Los Estados Unidos de America, tierra prodigiosa, fecunda y productiva, concentra, sin embargo, los poderes mas grandes del mundo y a algunos de los seres mas avariciosos y despiadados y aun, antihumanos, quienes han manejado durante 250 anios la tesis del Destino Manifiesto (America for Americans...), y por tanto no solo tomaron con violencia genocida la tierra de los Nativo Americanos, sino (Howard Zinn dix it), han devorado el continente en su conjunto.

Matizando su gula, esos poderes han creado (de comun acuerdo con las incipientes democracias del resto del continente), proyectos de Libre Comercio en los que lo unico libre es el paso marcial de las corporaciones y megacentros comerciales, en detrimento de las iniciativas del comercio justo, que han practicado nuestros pueblos milenarios. La presencia gladiadora de esos proyectos, han claramente fracasado en su "tesis" del desarrollo (y quedan un algunas buenas Memorias del subdesarrollo que comentar), simplemente aplastando la mano de obra barata, generando desplazamientos de habitantes originarios y produciendo, obviamente, fenomenos de migracion.

El pais de la Inmigracion se llama Estados Unidos de America. Todos somos inmigrantes aqui. Los Actos que avalan la existencia de "Reservaciones" (en condiciones a veces infrahumanas e indignas), de los Indigenas Nativo Americanos, siempre luchando por su supervivencia etnica, linguistica y ecologica, los han tambien desplazado, y a veces son inmigrantes-desplazados dentro de sus propias tierras milenarias.

Los inmigrantes de origen europeo, quienes han detentado el poder y son mayoria etnica hoy, son tambien hijos, nietos y choznos de inmigrantes europeos y la minoria que hizo suya el Destino Manifiesto, necesito "inmigrar", es decir, desplazar de su nativa Africa, a millones de esclavos. La mayoria etnica inmigrante de origen europeo, son tambien inmigrantes, cuyos ancestros quiza no hablaban ingles muy bien cuando llegaron, generando comunidades de habla alemana, danesa, sueca, rusa, etc., que se ha combinado con los fenomenos recientes de inmigracion latinoamericana, asiatica lejana, asiatica del Este medio, polinesica, etc.

TODOS SOMOS INMIGRANTES
Si antes, por decreto, los inmigrantes angloeuropeos (caucasicos) definieron una independencia de las coronas europeas, a traves de un acto de legalizacion en un territorio que ocuparon con violencia, cual seria entonces la altura moral para negar la inmigracion de quien llega, atravesando cientos de conflictos y situaciones de violencia racial, sexual y economica, para mejorar sus condiciones de vida y la de sus familias, y con quienes con su trabajo, impuestos y calidad humana, han logrado que esos mismos detentadores del poder, sigan teniendo palacios suntuosos y una sociedad opulenta minoritaria, que actua a veces en contra de sus propios companieros de etnia y de creencias religiosas.

Yo tambien me uno a la marcha. Y si hay que dar mas razones, creo que la aspiracion legitima de cada ser humano, podria quedar en este mensaje: "nadie elige donde nacer, pero todo mundo tiene derecho a elegir donde quiere vivir, con quien quiere vivir, como quiere vivir, y quiza, donde le gustaria morir..."

Yo marcho hoy por los caminos de la madre tierra, en un pedacito del planeta, muy beneficiado por la ostentacion y el lujo, con mis pasos de cantor que trata de interpretar el clamor de la gente, y convertirlo en un cantico profundo, que mueva los corazones de los genocidas y quienes encuentran en la violencia su unico argumento... Yo caminare este dia, con mi corazon abierto, con el cielo abierto, con los millones de silencios y de lagrimas, que se juntan en mi vida, pues quisiera que mis sobrinitos puedan viajar libremente por la tierra que conocen, la que los vio crecer, que es la misma tierra en la que habran de enterrarnos. Nuestra Madre Tierra. Yo marcho hoy, marchare viendo el cielo y viendo como la gente sube sus corazones hasta el cielo, para clamar juntos por Justicia, Dignidad y el cambio de la situacion economica en el mundo.

YO MARCHO HOY, CON EL AMOR MAS GRANDE QUE PUEDA CONTENER UN SER HUMANO, POR UN PUEBLO QUE MERECE JUSTICIA.
